Terms & Conditions

General Conditions

This web document represents the entire agreement between the client and ARTISTours, the tour organizer. ARTISTours will be responsible to the client for supplying the services and accommodations as described at www.artistours.com, except where such services cannot be supplied or the itinerary used is changed due to delays or other causes of whatever kind, including acts of nature, that are beyond the control of ARTISTours.

In such circumstances, we will do our best to supply comparable services, accommodations and itineraries, and there shall be no refund associated. ARTISTours and its agents (collectively ‘ARTISTours’) act only as an agent for the client and upon the express condition that ARTISTours shall not be liable or responsible for any direct, indirect, consequential or incidental damage, injury, loss, accident, delay or irregularity of any kind, which may be occasioned by reason of any act or omission of any third party (including without limitation, any act, inaction or breach of contract of any third party, which supplies any goods or services for the trip). Without limiting the foregoing, ARTISTours does not own or operate any third party suppliers of services such as hotels, restaurants, transportation companies, sightseeing companies or local tour operators. ARTISTours is not responsible for any injury, death, loss or expense due to default of any third parties, sickness, weather, strikes, acts of God, acts of Government, acts of terrorism, criminal activity, war, quarantine, force majeure events, overbooking of accommodations or any other cause beyond its control. All such risk, loss and expense must be borne by the client. Occasionally, it may be necessary to alter or amend itineraries, accommodations and sightseeing arrangements from those published. This may be due to road, weather and other operational needs prevailing at the time, and is always made in the best interest of the client’s comfort. Any personal expenses incurred by a client as a result of any delay, alteration or curtailment of any tour, whether caused by mechanical defect, strikes or any other cause are the responsibility of the client (we strongly recommend all clients obtain travel insurance). The organizer is unable to guarantee exact arrival and departure times, and is not liable for any failure to make connections with any other service, or guarantee the operation of any particular service. In the case of breakdown and other unforeseen circumstances, the operator reserves the right to substitute vehicles other than specified, to ensure the operation of a tour. These vehicles/vessels may not have some of the features described. Please note that if the client arranges for payment through an unaccredited agent, the unaccredited agent is not our agent for the purpose of receipt of monies. Receipt of deposits and subsequent payments by the travel agent does not constitute receipt of those monies by ARTISTours, and the travel agent has no authority, expressed or implied, to receive monies on the behalf of ARTISTours. There is no liability on the part of ARTISTours, in respect of any monies paid to the client’s travel agent. The organizer reserves the right to cancel any ticket or booking, or to refuse to carry any client where payment has not been received by the organizer within the specified time. The organizer reserves the right to amend or cancel tours at any time.

Payments & Cancellations

All tours require a non-refundable reservation deposit of 300€ per person to be paid at the time of booking. The booking is confirmed once the deposit is received. The remaining balance is due 60 days prior to the start of the tour. If you sign up for a tour within 60 days of the scheduled start date, full payment will be required before we can confirm you on the tour and the deposit portion will be non-refundable. Missing the final payment deadline, as noted on your tour invoice and your initial tour confirmation letter, may result in your being removed from the tour. Please make a note on your calendar of your final payment due date, as it is your responsibility to ensure that we receive your final payment in a timely manner.

No refunds are available once a tour or service has commenced, or in respect of any package, accommodation, meal or any other service utilized. Canceling a booking with ARTISTours can result in cancellation fees being applied, as outlined below. When canceling any booking you will be notified via email, facsimile or telephone of the total cancellation fees.

Privacy and Personal Data Collection

We are committed to protecting our customer’s personal data in a way that we collect only essential basic information about our clients that are necessary for fulfilling our obligations. We also inform our clients about the way we collect information and regularly give customers an option about how their information will be used, including the possibility to decide whether their name should be included or omitted from the lists used for marketing campaigns.

All user information is strictly guarded and is available only to the employees who need the information for completing their job. All of our employees are responsible to follow the principles of confidentiality protection.

Pricing & Inclusions/Exclusions

Prices listed on www.artistours.com are per person, unless otherwise specified. Price quotations are subject to change without notice, until a booking has been confirmed. Prices listed in ARTISTours programs are based on contracts with our partners and do not have to conform to prices advertised at the traveler’s destination and an eventual price difference cannot be subject to complaint. Unless otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, airport/port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax. Prices do not include tips/gratuities to tour directors, restaurant service, drivers or local guides; passport and visa fees; any travel or other costs incurred outside the tour itinerary; baggage and personal insurance; any items of a personal nature; and any beverages or food not specifically listed under “Inclusions” on the “Tour details” pages of www.artistours.com .

The tour organizer may require that a traveler executes payment on the spot for a specific service that will be utilized outside of the tour itinerary. For services that are paid for on the spot, the traveler submits any eventual disputes directly to the executor of the services.
ARTISTours can request an increase of the agreed upon price a maximum of 21 days before the beginning of the trip if, after the contract was closed, there was a change in the currency rates or an increase of the costs of transport, hotel or other services included. This includes the costs of fuel or an increase of a fee for certain services which influences the price of the tour, where there was no way it could have been known beforehand. In that case, the price of the arrangement will be increased reciprocally to the increase of the prices of its calculative elements. The passenger is obligated to accept the increase of the agreed upon price up to 10% and no consent is required. Should an increase greater that 10% in the vacation price be unacceptable to the passenger, the client is obligated to inform ARTISTours of this within 2 work days from the received notification and has the right to cancel the arrangement with a full refund of monies paid. If the traveler does not deliver the cancellation request to ARTISTours in written form within the stated time period, it will be assumed that the traveler agrees with the price change.

Passport & Visas

Each passenger is responsible for ensuring he or she has the appropriate and valid documents for the journey, especially (but without limitation) if booked tours, packages or transfers include flights or visits of a country different from the country of departure. The passenger has to own and bring a passport (with visa, if necessary) or a valid ID card. No refund will be granted in case of lack or loss of identifcation documents.

Circumstances Beyond Our or Our Suppliers’ Control

No compensation of any kind or responsibility can be taken if, due to circumstances beyond the control of ARTISTours or the relevant service providers, we or the relevant service providers notify you of a change to your arrangements and/or cannot supply your arrangements in full or in part as agreed, or you suffer any loss or damage of any kind. A circumstance beyond our or the relevant service providers’ control is one that cannot be foreseen or avoided, even after taking all due care and includes but is not limited to war, terrorist activity, civil unrest, industrial disputes and bad weather situations or forecasts.

Special Requests

Please inform us at the time of booking of any special requests for any service or facility that is not included as part of your booking. We will enquire with the relevant service provider and, where possible, will try to accommodate your request, but please note such requests cannot be guaranteed.

Acceptance of Terms & Conditions

It is understood by ARTISTours that the Terms & Conditions of travel are accepted by the passenger when the required reservation deposit has been paid.

Travel Insurance

The Client is strongly advised to arrange comprehensive travel insurance, including trip cancellation and liability coverage, full coverage for their (or their party’s) personal belongings, accident and emergency coverage, travel health insurance, etc., as neither ARTISTours nor our suppliers can be held responsible for any liability, expenses or losses incurred as a result of being inadequately insured. We highly recommend that at the time of booking a comprehensive travel insurance policy is purchased. By submitting the Booking Request Form, it shall be considered that clients have been offered and recommended the above mentioned travel insurance package.

Your Responsibility

Please note you are responsible for your and your party’s actions. If we or our suppliers believe your actions, or those of your party, could cause danger, or upset or annoy other customers, guests or staff, we or our suppliers may end your booked arrangements immediately. In this event, neither ARTISTours nor the relevant service provider(s) will pay compensation, make refunds nor pay any expenses suffered as a result. You are responsible for your personal safety and for the safety of the people accompanying you. Please take time to understand and then conform to the health and safety rules stipulated by the relevant service provider or the facility or by the appropriate government authorities.

You agree to defend and indemnify ARTISTours, its affiliates, and/or their respective suppliers and any of their officers, directors, employees and/or agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including, but not limited to, reasonable legal and accounting fees, brought by:

·         you or on your behalf in excess of the liability described above; or

·         by third parties as a result of

·         your breach of this agreement or the documents referenced herein;

·         your violation of any law or the rights of a third party; or

·         your use of this website.

Airport and Port Transfers

You are responsible for providing precise arrival time and pick up location information (such as airport, flight number, cruise docking port, hotel address, etc.) at least 72 hours before the travel date to the contact e-mail or phone numbers mentioned in the booking voucher. Failure to do so can lead to loss of service and ARTISTours, its affiliates or the relevant service provider(s) will not be liable for any refunds or penalties.

Itineraries are correct at the time of publishing, but are subject to change without notice. This could come about due to road or weather conditions, or any changes imposed by other tour operators and carriers included in the itinerary. If a passenger amends their itinerary by starting or concluding the itinerary earlier or later or during an itinerary then it becomes the passenger’s responsibility to arrange tour or flight connections as necessary.

In the unlikely event that the tour tutor is unable to perform his or her duties due to unforeseen circumstances, ARTISTours reserves the right to substitute another artist as tutor, or to continue with the tour as planned, or to refund the entire amount paid to ARTISTours for the applicable tour.

Cruise Itineraries

After departure of a cruise, on occasion and due to unforeseen circumstances or circumstances beyond our control such as exceptionally bad weather, navigational restrictions or other operational difficulty, in the interests of client safety or comfort, the skipper or captain may make required changes to the itinerary at his discretion. Cancelling a port or ports of call or making required changes in the itinerary does not entitle passengers to any make claims against us, or to any refund. If necessary, an itinerary may be changed or vessel substituted before or after commencement of the cruise. During the holiday, should the yacht or vessel sustain a breakdown in machinery or equipment disrupting the cruise itinerary for more than 24 hours, and if no alternative arrangement or substitute vessel is offered, then passengers will be entitled to a proportional refund for those cruise days not completed.

Most changes to holiday arrangements are minor. Occasionally, we have to make a “significant change”. Significant changes include the following changes when made before departure: a change of yacht or accommodation to that of a lower official classification or standard for the whole or a major part of the time you are away, a change of sailing or accommodation area for the whole or a major part of the time you are away, a change of outward departure time or overall length of time you are away of twelve or more hours, or a change of departure point to one which is more inconvenient for you.

If we have to make a significant change to or cancel your booking, we will inform you as soon as possible. If there is time to do so before departure, we will offer you the choice of the following options:

1.     accepting the changed arrangements or

2.     purchasing alternative arrangements from us, of a similar standard to that originally booked, if available. We will offer you at least one alternative of equivalent or higher standard for which you will not be asked to pay any more than the price of the original holiday. If this holiday is, in fact, cheaper than the original one, we will refund the price difference. If you do not wish to accept the holiday we offer you, you may choose any of our other available holidays. You must pay the applicable price of any such holiday.

3.     canceling or accepting the cancellation, in which case you will receive a full and quick refund of all monies you have paid to us.

The client may either accept or refuse the amended program within 2 business days of receipt of ARTISTours notification.

Coach Tours Itineraries, Smoking and Seat Rotation

We have a “no smoking” policy on our tours. While we welcome smokers on our tours, they are not allowed to smoke at group events, on the bus or at meals, for the comfort of all guests.

To enable everyone the opportunity of enjoying window and front seats, clients are advised to change seats on the bus daily during the course of the tour.

Tour Amendments and Cancellation

Cancellations and Amendments Cancellations received by the passenger in writing 61 or more days from the date of tour start will result in the loss of deposit, but a full refund of the balance of the tour price. Cancellation received by the passenger 31 – 60 days before the tour start will result in a 50% refund of the tour price. Any bank charges on refunds will also be deducted from any refund as they are at the passenger’s expense.

Cancellations received 30 or fewer days before departure will result in the loss of all monies paid, so please ensure you have purchased your own travel insurance. There are no refunds for services not utilized while on a tour. All cancellations must be sent to ARTISTours in writing via email specified in the booking document and will be effective on the date received by ARTISTours.

ARTISTours is authorized to completely or partially terminate the tour contract by a unilateral statement, without the obligation of damage compensation to the traveler, in the event of external uncommon and unpredictable circumstances that could not have been prevented, avoided or eliminated, and if they were to exist at the time of concluding the contract for organizing the voyage, would have been a justified reason for ARTISTours to not conclude the contract. In such a case, the traveler has the right to reimbursement of the paid amount in its entirety i.e. the difference in the cost between the contracted and offered services.
ARTISTours reserves the right to cancel voyages, no later than 5 days before the beginning of the voyage, if the voyage was cancelled by the travel organizer for which ARTISTours was an intermediary or if the minimum number of travelers necessary for the realization of a travel arrangement, stated on each individual travel program, did not register for a specific voyage or for any other justified reason. Each tour has been priced on the basis of a minimum number of 10 members traveling. In the event that fewer than the minimum number of members have confirmed booking 60 days from the date of commencement, ARTISTours reserves the right to cancel the tour, giving a full refund of monies paid, or to offer arrangements to proceed with the tour at a modified price. If ARTISTours cancels a tour you have reserved, the entire amount you have paid to ARTISTours for the applicable tour will be refunded to you within fourteen days after the tour’s cancellation. Once this occurs, ARTISTours has no other obligations to tour members on cancelled trips, including any additional costs or fees related to the issuance and/or cancellation of airline tickets or other travel reservations not made by ARTISTours.
ARTISTours reserves the right to change the date or hour of travel due to changes in flight schedules or due to the occurrence of unforeseeable circumstances, as well as the right to change the direction of travel if the conditions of travel change (flight schedule change, security situation in a specific country, natural disasters or other situations where ARTISTours has no influence), without damage compensation, and in accordance with valid regulations in domestic and international traffic.
ARTISTours shall not be held responsible for changes due to unforeseeable circumstances and force majeure during the voyage. ARTISTours shall not be held liable for printing errors of programs in the context of brochures/catalogs as well as for erroneous inputs of data by operators of ARTISTours websites.

We regret we are not in a position to offer any assistance in the event of delay at your outward or homeward point of departure. We cannot accept liability for any delay which is due to any reason, including the behavior of any passenger(s) who, for example, fails to check in or board on time.

Safety Standards

The safety standards and regulations are those of the country where the tour is located, and not necessarily the same or equivalent standards of your country. The monitoring, enforcement and compliance with local regulations is carried out by the appropriate authorities in the country concerned. We urge you to take all reasonable precautions to protect yourself while on holiday.

Disabilities and Travel

We embrace all people, regardless of their physical conditions. One of our goals is to provide free access and expand travel opportunities for people with special needs in Croatia and abroad. However, it is not always possible to arrange and include special accommodations. You are responsible to verify with us before you book travel to ensure that special arrangements can be made if it is required for your needs. ARTISTours travel arrangements can involve a considerable amount of walking and stair climbing in the regions visited and it is important that all members have a level of physical fitness that allows them to take part in these activities without the need of assistance from others.

ARTISTours or local providers are not liable for any incidences or consequences incurred during travel or complaints or lawsuits during or after travel due to your failure to inform us of your special needs. You also have the responsibility to re-confirm with us, upon booking, that special accommodations will be provided per your request.

Medical Conditions, Pregnancy and Travel

If you have a medical condition, or if you are pregnant and considering travel, you must consult with your doctor before you travel, especially if the medical condition requires daily routine care, urgent care, or your pregnancy is high-risk. You are responsible for disclosing any related information to us during the booking process by adding special comments. You understand ARTISTours or local providers are not in a position to provide any medical services or urgent care in the event such an action may be required. You are liable for any risks, incidences or consequences incurred during travel. We highly recommend that you purchase medical insurance and travel insurance before you travel.

Art Supplies

All art supplies must be brought with the passenger for all days of the painting tour. ARTISTours is able to provide lightweight easels, painting boards and folding chairs.

Your Eligibility

You must be 18 years of age or older to book a tour. If you are under 18, you may use www.artistours.com only with involvement of a parent or legal guardian.

Important Note

Compensation will not be provided if we need to cancel or in any way change your holiday due to war, threat of war, riots, civil commotion, industrial disputes, disaster, terrorist activities, technical or other problems with transportation, closure of airports or seaports, alteration or cancellation of scheduled services.

ARTISTours will not reimburse any customer who changes, or does not utilize any part of the package arrangements which have been booked and paid in full.

Travel organizer has obtained an insurance contract (guarantee) in case of insolvency or bankruptcy and a liability insurance contract, of which passenger will be informed on the booking document.

Any problems that might occur while on holiday should be reported at the earliest opportunity to the local supplier, representative and ARTISTours so it can be rectified. Complaints must be submitted in writing to ARTISTours within 8 days after the finalization of your tour. Complaints issued after the deadline of 8 days will not be taken into consideration. We emphasize that it is in the best interest of the traveler to perform in good will and to show good will in solving the complaint during the trip and to submit the written complaint to the service provider on the spot (front desk, transport operator, caterer or travel agency in the destination) and to seek a written confirmation from the service provider that they received the complaint. Each passenger must issue a complaint individually. Group complaints will not be taken into consideration. ARTISTours will issue a written solution for the complaint within 15 days after receiving the complaint. ARTISTours will solve only those complaints where the traveler submits evidence that he has submitted a complaint to the service provider on the spot and that the cause could not be eliminated on the spot.
